Water Pooling

On average, Iowa receives about 4 feet of precipitation on average throughout the year. When the rain is falling, and as the winter’s snows are thawing, that water has a nasty tendency to collect in holes, indentations, and furrows in the streets. For drivers of automobiles and trucks, pooled water is something of an inconvenience, and to pedestrians on city sidewalks it can be a drenching menace.

But for a motorcyclist, water pooling can spell disaster. If the water is deep enough, it can slow the rotation of the wheel as it passes through the pool, causing an imbalance that may lead to a crash. Even if the water is shallow, it can wet the tire, making it too slick to gain traction on dry pavement beyond the pool of water. If that happens, skidding is almost guaranteed, and an accident may not be far behind.

Obviously, the weather is not legally liable for your accident, but the entities charged with maintaining the integrity of the streets and highways have an obligation to prevent the sorts of roadway defects that permit the pooling of water in dangerous areas. Any failure to do so has the potential to result in a motorcycle accident; if you have been the victim of a crash attributable to water pooling on the road, you may be entitled to financial compensation from those parties.
