Lane Splitting
Lane splitting occurs when a motorcycle rider travels between car lanes on congested roads. The practice is legal in most states, and very few have any restrictions on splitting. States like California only require riders to do it in a “safe and prudent manner.” However, a few states, like Nebraska, prohibit lane splitting altogether. Recent debates in various legislatures suggest that more states may adopt lane splitting restrictions in the coming years.
Liability in Lane Splitting Accidents
When a motorcycle rider is lane splitting and is involved in an accident, the level of responsibility on the rider often depends on one of the following circumstances:
- The speed of the motorcycle relative to other cars
- The extent of possible traffic violations by the motorcyclist and other vehicles
- Whether the car driver attempted to switch lanes and used a turning signal
- Whether the motorcycle was in the driver's blind spot
Filtering
Filtering is a type of lane splitting. It is the practice of passing stopped or slow-moving traffic by traveling in unused lane space. Filtering is a very risky practice because motorcyclists could be hit by car doors suddenly opening or cars rapidly moving between lanes. For the most part, the same laws that regulate lane splitting also regulate filtering.
